Shueh Chien is a Singapore-qualified lawyer called to the Bar in 2022. He specialises in financial regulatory and digital asset matters, with experience advising on AML/CFT compliance, capital markets regulation, payment services, and cross-border regulatory issues.
Prior to joining Focus Law Asia, his practice focused on helping financial institutions, fintech companies, digital asset businesses, and investment managers navigate complex regulatory frameworks and licensing requirements in Singapore.
Shueh Chien was previously a civil and commercial disputes lawyer, with a focus on insolvency-related matters.
Work Highlights
Advised a leading global technology company on the regulatory treatment of its proposed business model for its internet storefront under the Payment Services Act 2019, including a detailed assessment of the scope of regulated payment services and the potential application of the “commercial agent” exemption. Successfully restructured the client’s intended commercial arrangement to mitigate licensing and compliance risks in Singapore.
Advised a capital markets services licence holder licensed under the Securities and Futures Act 2001 to deal in capital markets products on whether their products with novel features fell within the scope of their authorised activities, allowing the client to deal in those products in compliance with Singapore law.
Advised an ASEAN-supported multinational insurance provider specialising in disaster risk coverage on a retainer basis. The work included reviewing funding agreements, policy and programme documentation, and operational contractual terms to ensure compliance, clarity, and effective risk allocation.
Advised a Singapore broking arm of one of the largest banks in China on a retainer basis. Restructured client’s terms and conditions to enable their customers to engage in short sales of securities across multiple Asian jurisdictions.
Advised a Singapore arm of one of the largest asset management companies in China on a retainer basis. Prepared investment advisory agreement between the client and their related corporations that was compliant with Singapore’s stringent rules and regulations on outsourcing.
Advised an international fintech company and a Major Payment Institution on ad-hoc regulatory issues. Engaged with MAS to successfully address queries on certain inconsistencies the client’s regulatory submissions going back to 2022.
Lead the bankruptcy application for USD 12 million against a client debtor of a securities brokerage. Successfully resisted a jurisdictional challenge mounted by the Defendant.
Reviewed and advised on a wide range of general corporate documents and contracts, such as SLAs, NDAs, JVAs, SHAs, MOUs, company resolutions, and outsourcing agreements to support institutional clients.
